de Poel provides agency solution to tackle new tax legislation
Independent consultants de Poel Consulting have recently undertaken a series of agency seminars to address the issues raised by the new tax legislation relating to Managed Service Companies. John Simmonds, Managing Director, led the seminars and toured the country addressing any major issues raised by recruitment agencies.
The legislation which became law in April 2007 and resulted in the closure of current composite and Managed Service Company Schemes, is set to have a huge impact on agencies and clients alike, making them liable for employees unpaid tax and National Insurance.
de Poel conducted in depth research before appointing ESENTUAL as their approved partner. ESENTUAL offer a fully HMRC compliant and easily implemented alternative to the recently prohibited schemes.
ESENTUAL are an Employment Management Company, not a composite company, and do not pay their workers via dividends or through an intermediate company. By paying their workers PAYE and by paying employers national insurance, ESENTUAL fall outside the new Managed Service Company legislation and can offer a viable solution to the problem.
The ESENTUAL solution is of benefit to all parties. Workers are able to increase their PAYE take home pay whilst agencies are able to see a dramatic rise in their profit margin as a result of significantly reduced Employer National Insurance contributions.

The seminars which took place in early July were organised by de Poel’s Agency Liaison Manager, Lara Watson, specifically to tackle the issues involved with the changing legislation and to reiterate the benefits of the ESENTUAL solution.
Agencies across the country have embraced the solution. They feel this scheme alleviates them not only of the administrative burden but also the legal implications associated with the new legislation. 90% of agencies who attended the seminars were keen to engage with ESENTUAL.
